Flight Circle, LLC. is the owner of the FlightCircle.com website.  We respect your privacy and are committed to protecting it.  We have developed this Privacy Policy to safeguard the information that you provide to us, in accordance with relevant laws and regulations.

 

This Privacy Policy describes how we gather and use personal information through the FlightCircle.com website.  It provides necessary information to you regarding your rights and our responsibilities, and explains how, why, and when we process your personal data.

 

You should read this Privacy Policy carefully.  By using the FlightCircle.com website, you agree to the collection and use of your information as outlines in this Policy.  If you do not agree to this Policy, you should not use the FlightCircle.com website.

 

Emails from FlightCircle.com and the FlightCircle.com website itself may contain links to other websites, including sites that may or may not be owned or operated by Flight Circle.  Unless otherwise explicitly stated, Flight Circle is not responsible for the privacy practices or content of such websites, including their use of any information (such as IP address, browser type, or operating system) collected when you click through to such websites.  If you visit such websites, you should become familiar with the privacy practices of those websites.

 

We may update this Policy from time to time to reflect changing technology and other factors.  We will notify you of such changes by posting the latest updated Policy to this page.  You should bookmark this page and periodically review it to ensure that you remain familiar with the most current version.  By continuing to use the FlightCircle.com website, you consent to the latest version of this Policy.

  1. Information That We Collect

 

Flight Circle, LLC. processes your personal information to meet our legal, statutory, and contractual obligations, and to provide you with our products and services.  We do not collect unnecessary personal data from you and do not process your information in any way other than as specified in this Policy.

 

We collect three basic types of information from you:

 

  1. Non-Personally Identifiable Information.  This is general information that cannot be traced to individuals and contains no personalized data.  When visitors come to our website, we collect and aggregate information indicating, among other things, which pages of the website were visited, the order in which they were visited, and which links on the site were clicked.  Collecting such information involves logging the IP addresses, operating system, and browser software used by each visitor to the website.  Although such information is not personally-identifiable, it may be possible to determine from an IP address a visitor’s Internet Service Provider and the general geographic area from where the visitor accessed the website.  We use this information to make modifications and improvements to the website and to provide users with a smoother and more efficient experience.

Required Personally-Identifiable Information.  We collect this information as needed to provide you with the services you wish to access.  You provide this information to us directly, such as when you create an account, provide your name, address, and billing information, and make use of the various services that we provide.  This personally-identifiable information may include the following, which we use as indicated below:

 

  1. Name: used to create your account and for billing purposes;
  2. Date of birth:  used to ensure your identity and age;
  3. Mailing and Billing Addresses:  used to communicate with you and for billing purposes;
  4. Email Address:  used to create your account and for communication, including system emails, customer support, to notify you of upcoming reservations, upcoming currency expirations, as well as notices and other informational disclosures.  Additionally, you may opt-in to receive the Flight Circle newsletter to stay up-to-date on changes in services and new features and tips, as well as questionnaires.  You can change your opt-in choice at any time in the My Account section;
  5. Telephone number(s):  used to communicate with you and to confirm your identity;
  6. Credit/Debit/Bank Account numbers:  used to process payments for services you request.
  7. Answer to a security question: used to confirm your identity.

 

  1. Information Security

 

Flight Circle is committed to handling your information with high standards of security.  All communication between you and the website are handled using current encryption protocols by creating a secure link between your computer and FlightCircle.com’s servers.

 

We follow the Payment Card Industry Data Security Standards (PCI-DSS) when handling credit card data and we work hard to protect you and your information from unauthorized access, alteration, disclosure, or destruction.  We have several layers of security measures in place, including but not limited to:

 

  • Robust access controls
  • Multi-layered defenses
  • Vulnerability management, intrusion detection, monitoring, and testing
  • A mature InfoSec policy

As an extra level of security, Flight Circle employs outside companies to regularly test our site and examine our security policies to make sure we’re doing all we reasonably can to protect your personal information.

 

Unfortunately, no system can be guaranteed to be 100% secure.  You provide all information to us at your own risk, but please remember that these risks can be minimized by using responsible browsing habits such as using anti-virus software and similar measures, and by not re-using passwords for multiple websites.

 

Do not share your Flight Circle password with anyone. If you share your password you will be liable for activity with your information. If there is any doubt that you are the only one with your password you should login to Flight Circle and change your password. You should never email any sensitive information such as your password, credit card, or bank account information. Flight Circle will never ask you to send your password to us via email. When you enter login information, the address bar at the top of your browser should read https://www.flightcircle.com/.  Always check for this before you enter sensitive information.

 

We also recommend that you keep your operating system and browser version up-to-date with the latest security patches which will help ensure the protection of your information. 

 

We will never send you an email asking that you send us sensitive account information such as your username, password, or payment information through email.  Rather, you will provide that information only through our secure website located at https://www.flightcircle.com, or in some cases over the telephone but only if you initiate the phone call to us by dialing the contact number listed on our website.  If you receive an unsolicited email or telephone call asking you to provide such information, please refuse to provide the information and notify us immediately.

 

III. Disclosure of The Information We Collect

 

We take your privacy very seriously and will not rent or sell any personally identifiable information to third parties. The Flying Organization you register with has access to the personally-identifiable information that you provide to Flight Circle, except for the password you use to access the FlightCircle.com website.  We provide access to your personally-identifiable information to your Flight Organization to facilitate your interactions with your Flight Organization, such as reserving and paying for use of aircraft.

 

Please note that by providing your personally-identifiable information to FlightCircle.com, you are affirmatively consenting that this information will also be made available to your Flying Organization.  Your Flying Organization has its own terms of use and privacy policy, and you should review your Flying Organization’s terms and policies.  By providing your personally-identifiable information to FlightCircle.com, you are consenting to the sharing of that information with the Flying Organization that you tell FlightCircle.com that you are associated with. FlightCircle.com has no control over, and no responsibility for, your Flying Organization’s use of your personally-identifiable information.  If you have questions about how your Flying Organization accesses, protects, and uses that information, please contact your Flying Organization for more information.

 

Flying Organization Use of Information

By entering into our Terms of Use agreement, with respect to other users’ personally identifiable information that you obtain through the site or Flight Circle related communication, the Flying Organization will not share information other than for internal purposes of conducting day-to-day operations and for approved communication in regard to its own privacy statement, or by the expressed consent of its users. In all cases users must be provided with a way to remove themselves from your database and review information you have collected about them. Under no circumstances, except as defined in this section, can you disclose personally identifiable information about users to any third party without our consent. We do not tolerate spam therefore you may not add a user to any spam mail list. To report spam, contact us.

 

Other Disclosure To Third Parties

 

Other cases where your personally identifiable information is disclosed to third parties:

 

  1. Service Providers:  We work with third parties who provide services, including but not limited to website hosting, order processing, age verification, credit card clearance, data analysis, emailing, marketing, targeting, training, and other services.  Some of these third parties may be given access to some or all of the information that you provide to us and may use cookies or other tracking technologies in connection with providing their services.  To the extent that we provide your personally-identifiable information to such third parties, we restrict their ability to use such information for their own marketing purposes to the best of our ability.  However, we cannot be responsible for the privacy policies or practices of such third parties.
    We use and transfer information received from Google Accounts and will adhere to Google API Services User Data Policy, including the Limited Use requirements.
  2. Related Companies:  We may share personal information we collect about you with related companies for purposes consistent with this Policy.
  3. As Required by Law:  Subject to applicable law, we reserve the right to release information concerning site visitors where the visitor is believed to be in violation of his or her obligations to us, is partaking (or is suspected of partaking) in any illegal activity, in response to civil or criminal subpoenas, court orders and/or discovery requests, to protect the interests of Flight Circle, our customers or others, and as otherwise permitted or required by law.

 

  1. Viewing, Updating, and Deleting Your Information

You can always review, update, and delete information that you provided by visiting the My Account section and making changes to that information by logging into your account.

 

  1. Additional Privacy Rights.

 

  • California Consumer Privacy Act

 

California residents have certain rights regarding our collection and use of personal information under the California Consumer Privacy Act of 2018 (“CCPA”).  Please note that this CCPA Disclosure controls as to California residents in the event of any conflict between this CCPA Disclosure and any other provisions of this Policy.  If you are a California resident, you may:

 

  • Request that we delete your personal information;
  • Request information about:
    • The categories and specific pieces of personal information that we have collected about you;
    • The categories of sources from which we have collected your personal information;
    • The business or commercial purpose for collecting or sharing your personal information;
    • The categories of personal information we have shared about you; and
    • The categories of third parties with whom we have shared, disclosed for a business purpose, or sold your personal information, and which categories of personal information we have shared, disclosed, or sold to which categories of third parties.

 

We will not discriminate against you for exercising your rights under the CCPA.

 

NOTE:  While under the CCPA you may request that we do not sell your personal information, there is no need to opt out of sales because we do not sell your personal information.

 

Exercising Your Rights:

 

Requests for information:

 

If you are a California resident, you may request that we provide certain information about our use of your personal information, as specified above.  Upon receiving a request from you, we will take reasonable steps to verify your identity.  We will respond to a verified request from you by: (a) providing the requested information; or (b) explaining why the Act does not require us to provide the requested information.

 

We will respond to requests for information within 45 days.  If a response requires additional time, we will notify you of the basis for the delay and may extend our response period up to an additional 90 days.  If the Act requires us to provide the information requested to you, we will provide the information covering the 12 months preceding the request, free of charge, and in a readily useable portable format.  We have no obligation to provide personal information to you more than twice in a 12-month period.  If a request or series of requests are manifestly unfounded or excessive, we may charge a reasonable fee for processing the request(s), or may refuse to process the request(s).

 

Requests to delete:

 

California residents may request that we delete their personal information.  Upon receiving a request from you, we will take reasonable steps to verify your identity.  We will respond to a verified request from you by: (a) deleting your personal information and, if applicable, directing our service providers to delete your personal information; or (b) explaining to you why the Act does not require us to delete your personal information.

 

If a request or series of requests are manifestly unfounded or excessive, we may charge a reasonable fee for processing the request(s), or may refuse to process the request(s).

 

Minors:  We do not sell to or obtain personal information from persons under 18 years of age.

 

Personal Information We Have Collected, Sold, or Disclosed

 

In the preceding 12 months, we have collected the following categories of personal information about California residents:

  • Date of Birth
  • Postal Address
  • Billing Address
  • Credit or debit card information
  • Email address
  • Telephone number
  • Records of services purchased
  • IP address and geolocation
  • Analytics regarding interaction with our website
  • Device information (e.g. device type and model, operating system, device date/time, unique device identifiers, network information)

 

We do not sell, and have not in the prior 12 months sold, any personal information of California consumers.

 

In the preceding 12 months, we have shared for a business purpose the following categories of personal information about California users:

 

  • Identifiers, such as your name, IP address, email address, and similar identifiers.
  • Payment information: some personal information included in this category, such as your address, may overlap with other categories.
  • Internet or other electronic network activity information, such as browsing history, search history, or information on interaction with a website or advertisement.
  • Geolocation data: in some cases we may collect your physical location to provide you location-related services.
  • Inferences from any of the above information.

 

According to California law, personal information does not include (i) publicly available information from government records or (ii) de-identified or aggregated consumer information.

  • Transfers Outside the EU

 

Flight Circle, LLC. is located in the United States and as such all data is stored and processed in the U.S.  Personal data in the European Union is protected by the General Data Protection Regulation (GDPR).

 

  • Consequences of Not Providing Your Data

 

You are not obligated to provide your personal information to Flight Circle.  However, this information is required for us to provide you with our services.  We will not be able to offer some or all of our services without it.

 

  • How Long We Keep Your Data

 

Flight Circle only retains personal data for as long as is necessary to serve the purposes described in this Policy.  We will also retain and use your personal data for as long as necessary to comply with legal, regulatory, accounting, or reporting obligations, to resolve disputes, and to enforce our agreements.

Where you have consented to using your details for direct marketing, we will keep such data until you notify us otherwise and/or withdraw your consent.
